Zeidel & Associates Restructures Food & Beverage Operations for NYC’s Oldest Museum
Situation
Zeidel & Associates represented the oldest museum in New York City in overhauling its food and beverage operations. The museum’s F&B program included a full-service restaurant, a coffee bar, and event spaces for catered functions. Dissatisfied with the performance of its existing F&B manager, the museum sought to both terminate its current food and beverage management agreement and enter into a new agreement with a replacement manager.
Approach
The firm negotiated a separation agreement with the outgoing F&B manager to facilitate the early termination of the existing management agreement. At the same time, Zeidel & Associates began negotiating a new food and beverage management agreement with the incoming manager. The new agreement included provisions for re-concepting the museum’s F&B outlets and granted the new manager exclusive catering rights for the museum’s events, subject to limited exceptions.
Given the museum’s prior operational challenges, it was critical that the new agreement impose strict requirements on the manager regarding staffing levels and consistent operating hours. Zeidel & Associates incorporated strong performance standards, client remedies for failure to meet those standards, and monetary penalties in the event of an outlet closure caused by an inspection by the NYC Department of Health. Each of these protections addressed problems experienced under the prior F&B manager.
Result
The final agreements ensured a smooth transition between managers while positioning the museum’s F&B program for long-term success. By combining a clean contractual exit with robust operational safeguards in the new management agreement, Zeidel & Associates helped the museum protect its brand, enhance guest experience, and avoid the service and compliance issues that had hindered its prior F&B operations.
